Trudeau’s promises to Indigenous people and the climate mean game over for pipelines

Reconciliation with First Nations and strong action on climate change are two of the Liberal government’s most substantive policy promises. So far the Liberals have committed to act on all the 94 Calls to Action of the Truth and Reconciliation Commission (TRC) and signed onto the Paris climate agreement.

Prime Minister Justin Trudeau’s government has been quiet on how these two promises intersect with the controversial subject of pipelines.

Dru Oja Jay argues that to honour Indigenous treaties, including respecting free, informed and prior consent, and in order to reduce Canada’s greenhouse gas (GHG) emissions to safe levels, the Liberals would need to stop pipelines, including the recently flowing Line 9, and bigger projects like Northern Gateway, Energy East, and Keystone XL.

Jay’s logic then goes that protesters who manually shut down Enbridge’s Line 9 twice in December and Line 7 once in January were really just enforcing the Liberal’s own policies.

Does this unlikely position hold up? 

Reconciliation: Honour the treaties. Really.

The TRC has brought focus back to the long-standing treaty obligations Canada has with Indigenous people for the use their lands and what those treaties mean for industrial projects.

If Trudeau wants to live up to his call to implement all 94 recommendations, the argument goes that pipeline projects across Canada would have to be stopped because of violations of treaties and of nation-to-nation relationships.

“Contrary to colonial texts and practices of denial and appropriation, the historic treaties did not cede, release, surrender, yield, or extinguish Indigenous title, rights, or jurisdiction,” Lynn Gehl, Algonquin scholar of indigenous history, tells rabble. “Canada, the provinces, and corporations must gain Indigenous consent [for projects].”

Gehl has studied the founding treaties of Canada extensively. One foundational agreement, made in 1764, involved the exchange of three wampum belts, known together as the Treaty of Niagara bundle. It is through these beaded belts that an understanding of the relationship between the Indigenous nations and the settlers (British at that time) was agreed upon.

A core piece, then as now, was “the philosophy and practice of non-interference mediated by peace, friendship, and respect,” in Gehl’s words.

The TRC recommendation #45 states Canada “reaffirm the nation-to-nation relationship between Aboriginal peoples and the Crown” a concept Trudeau re-iterated to First Nations leaders on December 8, 2015:

“It is time for a renewed, nation-to-nation relationship with First Nations peoples: one that is based on the understanding that the constitutionally guaranteed rights of First Nations are a sacred obligation that we carry forward. This obligation is based on respect, co-operation, and partnership; it is guided by the spirit and intent of the original treaty relationship; and it respects inherent rights, treaties and jurisdictions, and the decisions of our courts.”

“In this context, our government will work collaboratively to further reconciliation, including the implementation all of the TRC’s 94 Calls to Action,” a spokesperson from tThe Ministry of Indigenous and North Affairs tells rabble.

“We are also working across government departments, provinces and territories, municipalities and with all Canadians to fully understand and implement the United Nations Declaration on the Rights of Indigenous Peoples.”

Mentioned eight times in the TRC Calls to Action is the United Nations Declaration on the Rights of Indigenous Peoples, with clearly states that Indigenous groups must give free, prior and informed consent for use of their lands.

Such consent, and the nation-to-nation relationship are central to the Chippewa of the Thames First Nation legal case claiming they were not consulted and did not give their consent to changes with Enbridge’s Line 9 pipeline on their land. Their case is heading to the Supreme Court of Canada. Their calls for treaty obligations to be honoured are echoed by the Chiefs of Ontario.

Similarly, Energy East does not have the consent of nations along its route, like Kanesatake and Kahnawake, and Northern Gateway is opposed by a long list of First Nations.

“Keep in mind,” says Gehl, “that progress for Indigenous people means taking the steps to ensure clean land, water, and air for all people. It is Canadians better option to stand behind Indigenous people and our knowledge philosophy and practices.”

End of the fossil fuel era

Canada is one of the highest per-capita emitters of GHGs and a producer of one of the higher-carbon sources of oil: tar sands bitumen.

But in Paris the Liberals committed to Canada doing it’s part to keep global temperature from rising 1.5 degrees Celsius, and definitely not more than 2 degrees.

“That has a very specific meaning,” Adam Scott at Environmental Defence tells rabble. “We have to reach net zero emissions by 2050. The Liberals have not changed the target from that of the Conservatives [30 per cent below 2005 levels by 2030]. And we need more than just commitments, we need real actions.”

“We’re still waiting to see what the Liberals climate plan will be,” says Andrea Harden-Donahue, Energy and Climate Campaigner with the Council of Canadians.

Trudeau said he will meet with the Premiers to work on a climate plan within 90 days of the Paris conference, which means mid-March. Today, Bloomberg Business reported the Trudeau government will begin preparing “transition plans” for exisiting pipelines and strengthen environmental review laws.

“If [the Liberal commitment] is more than hot air, it means this government must not approve new tar sands pipelines like Kinder Morgan’s Trans Mountain expansion and TransCanada’s Energy East,” adds Harden-Donahue.

“The Energy East pipeline alone could lead to a 40 per cent increase in tar sands production, which we will be locked into for 40 years. Ambitious targets require ambitious actions. This means freezing tar sands expansion and planning for a transition towards a fossil-free economy by 2050.”

Yesterday, Montreal mayor Denis Coderre announced his opposition to Energy East based on “environmental and economic concerns.”

It appears some groups believe the thesis holds: shutting down pipelines is in line with stated Liberal policy positions on climate. 

“We need to be walking away from new fossil fuel projects” says Scott of Environmental Defence.

Koch brother resigns from museum board after calls from scientists

For 23 years, David Koch, the billionaire industrialist who made a fortune off fossil fuels, ranching, fertilizers, and other environmental nightmares, has served on the board at the American Museum of Natural History. Koch’s position on the board is controversial, not least because of his position on climate change: The Koch family has spent millions funding climate change denier groups and disinformation campaigns, and scientists around the country have called for Koch to be removed from the museum board. Well, they finally got what they wanted — the American Museum of Natural History announced Koch’s resignation this week.

A museum spokeswoman said Koch’s departure is unrelated to the calls for his dismissal, but, as The New York Times reports, a letter sent to museums of science and history last year and signed by dozens of scientists stated:

David Koch is a major donor, exhibit sponsor and trustee on the Board of Directors at the Smithsonian’s National Museum of Natural History, and the American Museum of Natural History. David Koch’s oil and manufacturing conglomerate Koch Industries is one of the greatest contributors to greenhouse gas emissions in the United States. Mr. Koch also funds a large network of climate-change-denying organizations, spending over $67 million since 1997 to fund groups denying climate change science.

When some of the biggest contributors to climate change and funders of misinformation on climate science sponsor exhibitions in museums of science and natural history, they undermine public confidence in the validity of the institutions responsible for transmitting scientific knowledge. This corporate philanthropy comes at too high a cost.

Drawing on both our scientific expertise and personal care for our planet and people, we believe that the only ethical way forward for our museums is to cut all ties with the fossil fuel industry and funders of climate science obfuscation.

The letter was signed by prominent climate scientists James Hansen and Michael Mann, among others. The Natural History Museum, the organization that sponsored the letter, noted that Koch’s reaction was swift: Within 24 hours, “a lawyer with apparent ties to the Koch brothers filed OPRA requests (similar to FOIA) at public universities where several scientists who signed the letter are employed,” wrote the Natural History Museum’s Beka Economopoulos in a press release. “The requests called on the universities to turn over all emails in the scientists’ accounts with ‘Koch’ in the subject or body.”

The American Museum of Natural History isn’t the only museum with ties to the Kochs: David Koch also sits on the advisory board of the Smithsonian National Museum of Natural History — and he apparently holds a lot of sway. ThinkProgress reported last year about a Smithsonian exhibit that “thoroughly whitewashes the dangers of modern-day climate change.” The exhibit was made possible by a $15 million grant from none other than David Koch.

Proponents of so-called “abiotic oil” claim that the PROOF is found in the fact that many capped wells, which were formerly dry of oil, are found to be plentiful again after many years, They claim that the replenished oil is manufactured by natural forces in the Earth’s mantle.

Until now these believers in “abiotic oil” have been dismissed as professing “bad science” but — alas — a new study has proven them correct!

Reported in ScienceDaily, researchers at the Royal Institute of Technology (KTH) in Stockholm have managed to prove that fossils from animals and plants are not necessary for crude oil and natural gas to be generated. The findings are revolutionary since this means, on the one hand, that it WILL be much easier to find these sources of energy and, on the other hand, that they can be found all over the globe.

Abiotic Oil
The abiotic oil formation theory suggests that crude oil is the result of naturally occurring and possibly ongoing geological processes. This theory was developed in the Soviet Union during the Cold War, as the Union needed to be self sufficient in terms of producing its own energy. The science behind the theory is sound and is based on experimental evidence in both the laboratory and in the field. This theory has helped to IDENTIFY and therefore develop large numbers of gas and oil deposits. Examples of such fields are the South Khylchuyu field and the controversial Sakhalin II field.

“The savings will be in the many billions,” says Vladimir Kutcherov.

According to Vladimir Kutcherov, these research findings are extremely important, not least as 61 percent of the world’s energy consumption derives from crude oil and natural gas.

Indigenous Tribe Takes Oil Men Hostage After Spill In Peru ~ TheLipTV

The indigenous Wampis tribe in Peru’s Amazon seized a grounded military helicopter late on Sunday and took at least eight public officials hostage in an effort to draw attention to an oil spill that polluted its territory. The Wampis community is attempting to force the Peruvian government to respond to their desperate pleas for help more than a month after oil company Petroperu’s 40-year-old pipeline spilled 1,000 barrels of oil in Mayuriaga. Manitoba First Nation declares state of emergency over suicide epidemic

CROSS LAKE, Man. — A remote Manitoba First Nation declared a state of emergency Wednesday after six suicides in the last two months and 140 attempts in the last two weeks alone.

Officials from the Pimicikamak Cree Nation, known as Cross Lake, say health workers on the northern reserve can no longer cope. Band councillor Donnie McKay said the nursing station is only staffed by two nurses overnight.

“They’re going 24 hours and they’re ready to drop.”

The community of 8,300 is traumatized and needs immediate help from the provincial and federal governments, McKay said. A meeting with Manitoba Health Minister Sharon Blady last month resulted in one mental-health worker being sent to the community for an eight-hour shift, he said.

“It’s ridiculous,” said McKay, who was called by distraught family members to a home a few days ago to talk a man out of taking his own life. “This wouldn’t happen anywhere else.”

Acting Chief Shirley Robinson said the reserve — about 500 kilometres north of Winnipeg near a Manitoba Hydro generating station — has an 80 per cent unemployment rate.

Frustrated residents occupied the generating station in 2013. They said their traditional lands are regularly transformed into a floodway and none of the promised economic development and employment programs has materialized.

Premier Greg Selinger personally apologized a year ago for the damage caused by the hydro development to Cross Lake’s traditional land, way of life and cultural identity.

After that apology, Robinson said there was a sense of hope, but that quickly vanished.

“There is lots of despair.”

Robinson’s 33-year-old cousin, a mother of three, was the sixth person last weekend alone to commit suicide. The community has been drawing on every resource it can to save lives, said Robinson.

“We’ve been using clergy. We’ve been using our local elders. We’ve been using our local nurses and doctors,” she said. “It’s been very difficult for everyone.”

Aboriginal Affairs Minister Eric Robinson said he has spoken with federal Indigenous Affairs Minister Carolyn Bennett and the two levels of government are doing what they can to assist the community. The province is waiting for specific requests from Cross Lake and will assist in any way it can, he said.

But the root causes of suicide — poverty, overcrowded housing and past abuse — need to be addressed, he said.

“Once those things are dealt with, it gives a sense of pride back to the indigenous people of this province,” said the minister, who is expected to travel to Cross Lake in the next few days.

A spokesperson for Indigenous and Northern Affairs Canada said in an emailed statement the department is working with the band council and other front-line workers to “identify need and take immediate action in response.”

“Health Canada officials have reached out to the Chief of Cross Lake First Nation to offer assistance, and will work with the community to help address their mental-health needs in this difficult time,” Michelle Perron wrote.

The band is asking for at least six mental-health workers immediately, as well as for a child psychologist and family therapist. Council is also calling for after-hours counsellors and physicians.

In the long term, the reserve is asking for a hospital and recreational facilities for its youth.

Shirley Robinson said, with every minute that passes, people are worried about losing another loved one. There were two suicide attempts Tuesday, she said.

“It seems like we’re (keeping) a watchful eye — every minute, every hour. We don’t want this to happen anymore. The whole community is in grief.”

Note: IMO this story has a very darkside that connects the protests with the suicides, one that goes beyond unemployment, poverty, drugs, alcohol and the lack of a recreation center – which is simply appalling and egregiously socially irresponsible, especially when considering the profits generated from the hydro-electric plant. Is the community dealing with scalar weaponry, HAARP, targeted chemtrail toxins or some other form of mind control technology that’s driving people into suicidal depression? With the rate of suicides escalating at such an alarming rate, imo there’s something else going on.  Exactly what, has yet to be determined.

I just made a trip to the California State capital to distribute boxes of geoengineering awareness materials (magazine copies, commercial DVDs, and color glossy flyers) to every office of every representative and senator. I also distributed to every committee, this is the sixth time I have done this. Those at the capital now know about climate engineering, and they now know we know they know. On the 5th anniversary of the catastrophic Japanese quake, how many Americans have completely forgotten about Fukushima? How many Americans have assumed that everything is now under control regarding the nuclear accident that occurred on that fateful day 5 years ago?  Such a conclusion could not be further from the truth. In fact, the situation at Fukushima is worse than ever. “Tepco” (the company that owns the Fukushima nuclear power plant) and the Japanese government knew on day one there were total meltdowns occurring in multiple reactors, they did everything they could to hide the truth. The real truth about Fukushima is this, the technology to deal with this catastrophe does not even exist, and we are building dozens more nuclear plants right now. Governments around the globe and the agencies they control are tasked with hiding countless converging catastrophes that are closing in from every side. How does the story end? What will be our individual parts in the play? Will we sit passively by and tell ourselves someone somewhere is watching the horizon and thus watching out for our welfare? Or we will accept the fact that such a notion is a total delusion? We must focus on the following fact, from nuclear meltdown to climate engineering,  if the current course of certain suicide for planet Earth and the human race is to be changed, it is up to us. In the list of the world’s great companies, Unaoil is nowhere to be seen. But for the best part of the past two decades, the family business from Monaco has systematically corrupted the global oil industry, distributing many millions of dollars worth of bribes on behalf of corporate behemoths including Samsung, Rolls-Royce, Halliburton and Australia’s own Leighton Holdings.

Now a vast cache of leaked emails and documents has confirmed what many suspected about the oil industry, and has laid bare the activities of the world’s super-bagman as it has bought off officials and rigged contracts around the world.

A massive leak of confidential documents has for the first time exposed the true extent of corruption within the oil industry, implicating dozens of leading companies, bureaucrats and politicians in a sophisticated global web of bribery and graft.

After a six-month investigation across two continents, Fairfax Media and The Huffington Post can reveal that billions of dollars of government contracts were awarded as the direct result of bribes paid on behalf of firms including British icon Rolls-Royce, US giant Halliburton, Australia’s Leighton Holdings and Korean heavyweights Samsung and Hyundai.

The investigation centres on a Monaco company called Unaoil, run by the jet-setting Ahsani clan. Following a coded ad in a French newspaper, a series of clandestine meetings and midnight phone calls led to our reporters obtaining hundreds of thousands of the Ahsanis’ leaked emails and documents.

The trove reveals how they rub shoulders with royalty, party in style, mock anti-corruption agencies and operate a secret network of fixers and middlemen throughout the world’s oil producing nations.

Corruption in oil production – one of the world’s richest industries and one that touches us all through our reliance on petrol – fuels inequality, robs people of their basic needs and causes social unrest in some of the world’s poorest countries. It was among the factors that prompted the Arab Spring.

Fairfax Media and The Huffington Post today reveal how Unaoil carved up portions of the Middle East oil industry for the benefit of Western companies between 2002 and 2012.

In part two we will turn to the impoverished former Russian states to reveal the extent of misbehaviour by multinational companies including Halliburton. We will conclude the three-part investigation by showing how corrupt practices have extended deep into Asia and Africa.

The leaked files reveal that some people in these firms believed they were hiring a genuine lobbyist, and others who knew or suspected they were funding bribery simply turned a blind eye.

The leaked files expose as corrupt two Iraqi oil ministers, a fixer linked to Syrian dictator Bashar al-Assad, senior officials from Libya’s Gaddafi regime, Iranian oil figures, powerful officials in the United Arab Emirates and a Kuwaiti operator known as “the big cheese”.

Western firms involved in Unaoil’s Middle East operation include some of the world’s wealthiest and most respected companies: Rolls-Royce and Petrofac from Britain; US companies FMC Technologies, Cameron and Weatherford; Italian giants Eni and Saipem; German companies MAN Turbo (now know as MAN Diesal & Turbo) and Siemens; Dutch firm SBM Offshore; and Indian giant Larsen & Toubro. They also show the offshore arm of Australian company Leighton Holdings was involved in serious, calculated corruption.

The leaked files reveal that some people in these firms believed they were hiring a genuine lobbyist, and others who knew or suspected they were funding bribery simply turned a blind eye.

But some knew much more. A handful of senior insiders at firms such as Spanish company Tecnicas Reunidas, French firm Technip and drilling giant MI-SWACO, not only actively supported bribery but pocketed their own kickbacks; US defence giant Honeywell and Australia’s Leighton Offshore agreed to hide bribes inside fraudulent contracts in Iraq; a Rolls-Royce manager negotiated a monthly kickback for leaking information from inside the British firm.

Many of those revealed to have been culpable, including the wealthy Ahsani family itself, which runs Unaoil, continue to operate with impunity.

The files expose the betrayal of ordinary people in the Middle East. After Saddam Hussein was toppled, the US declared Iraq’s oil would be managed to benefit the Iraqi people. Today, in part one of the ‘Global Bribe Factory’ expose, that claim is demolished.

THE BRIBE FACTORY

It is the Monaco company that almost perfected the art of corruption.

It is called Unaoil and it is run by members of the Ahsani family – Monaco millionaires who rub shoulders with princes, sheikhs and Europe’s and America’s elite business crowd. At the head are family patriarch Ata Ahsani and his two dashing sons, Cyrus and Saman. Their charities support the arts and children, and Ahsani family members sit on the boards of NGOs with ex-politicians and billionaires. Ten years ago, a spreadsheet showed they had cash, shares and property worth 190 million euros. They are members of the global elite.

How they make their money is simple. Oil-rich countries often suffer poor governance and high levels of corruption. Unaoil’s business plan is to play on the fears of large Western companies that they cannot win contracts without its help.

The multi-million dollar fees Unaoil takes from its clients are funnelled into an industrial scale bribery operation which further entrenches corruption among the powerful few.

Its operatives then bribe officials in oil-producing nations to help these clients win government-funded projects. The corrupt officials might rig a tender committee. Or leak inside information. Or ensure a contract is awarded without a competitive tender.

If you believe Ata Ahsani, it’s all above board: “We are not in the business of fixing jobs for people. Our work is basically very basic. What we do is integrate Western technology with local capability,” he told Fairfax Media and The Huffington Post.

Did Unaoil bribe public officials? “The answer is absolutely no”.

But the evidence of their own internal email cache, leaked to Fairfax Media and The Huffington Post, clearly demonstrates that the multi-million dollar fees Unaoil takes from its clients are funnelled into an industrial scale bribery operation which further entrenches corruption among the powerful few.

Bankers in New York and London have facilitated Unaoil’s money laundering, while the Ahsanis have built a major property investment business in central London. Since 2007, Unaoil has been certified by anti-corruption agency Trace International. This in itself raises serious questions about the worth of such international accreditation.

But for the Western companies confronted with questions under anti foreign bribery laws in their own jurisdictions, Unaoil appears to be a reputable and discrete middle-man, giving listed businesses what is known as “plausible deniability”.

Companies approached by Fairfax Media and The Huffington Post about their contracts with Unaoil have emphasised they have strong anti-corruption policies, and are committed to investigating their dealings with Unaoil.

IRAQ

After the US led coalition won the second gulf war, it went to guard the oil ministry – leaving the Baghdad museum undefended to be looted of its treasures.

But they did not save the oil industry from thieves. The Unaoil files reveal that Western companies, in concert with Iraq’s new elite, themselves began a sustained campaign of looting.

Unaoil paid at least $25 million in bribes via middlemen to secure the support of powerful officials – while complaining internally that they were “assholes, and greedy”.

Between 2004 and 2012, Unaoil corruptly influenced a Who’s Who of the country’s oil industry: the Deputy Prime Minister of Iraq turned education minister Hussain al-Shahristani; Oil Minister Abdul Kareem Luaibi (who was replaced in 2014); the Director General of the South Oil Company, Dhia Jaffar al-Mousawi, who in 2015 became a deputy minister; and top oil official Oday al-Quraishi.

The most senior politicians received multi-million dollar lump sums, while those lower down the food chain were paid lesser amounts. Quraishi, who oversaw Iraq’s most important oil industry expansion project, pocketed a monthly kickback of $US6000 – “$5K for him, and $1k he needs for presents to people within” – along with additional large pay-offs.

The minister, Dr Shahristani, who is now Iraq’s education minister, denied he had been involved in any wrongdoing. Other Iraqi officials did not respond to requests to comment.

Unaoil also bribed senior insiders working for the international oil companies which were contracted by Iraq to manage its oil fields. The leaked files reveal rampant corruption inside Italian oil giant Eni, which ran the tender processes for contractors working on the giant Zubair oil field.

Unaoil’s clients in Iraq included British giant Rolls-Royce, US firms FMC Technologies and Cameron, Italy’s Saipem, German company MAN Turbo, the US listed Weatherford, Dutch company SBM Offshore and Australia’s Leighton Offshore.
IRAN

Everything works and progresses on connections, relations with special talent”. So wrote an Iranian fixer, part of Unaoil’s remarkable network of insiders dedicated to paying and pocketing bribes. After the recent relaxing of United Nations, US and European sanctions, this network has become even more valuable.

In 2006, this Unaoil operative complained in emails that one of the company’s clients, UK firm Weir Pumps (now owned by US firm SPX), owed him hundreds of thousands of dollars which he had promised to use in part to sling to others in Iran.

“[It] is the end of Iranian new year here, expectations high, I am short in cash, and about five million pounds of business with Weir [is] in danger… Because I can not fulfill my obligations to my team of Supporters.”

If the money was not forthcoming, he warned, Weir Pumps risked “melting like a piece of ice, day by day.”

“…over half a million dollars of my consultancy fee… I have already spend it for the promotion of their businesses in Iran.”

A separate set of leaked memos from 2006 said Unaoil would pay “10 k/month” to secure the support of the managing director of a firm chaired by a high ranking Iranian official, part owned by an Iranian government entity and overseen by a board with “political influence.”

“MD [managing director]… wants $10k/month. AA [Ata Ahsani of Unaoil] agree to this given his excellent connections.”

Unaoil’s Iranian network – which was also used to assist firms such as ABB, Elliott and Japan’s Yokogawa – extends beyond the oil industry. In 2011, Unaoil helped solve a dispute involving one of its Australian clients by reaching out to “several influential contacts… including the head of the Iranian Police”.

Prior to the recent easing of sanctions, Unaoil used strategies including front companies to avoid the scrutiny of Western officials. It advised its corrupt fixers to not wire funds using US dollars and to use companies “not having the name Iran in it”.

LIBYA

In 2004, when the West began removing sanctions against Libya, and the regime of Colonel Gaddafi started dealing with foreign companies, Unaoil stood ready.

By 2011, its network of corrupt insiders included officials and front men able to influence the dealings of many of Libya’s most important oil and gas agencies.

In late 2008, a Canadian drilling firm, Canuck Completions, told Unaoil it was “curious about … what type of Baksheesh is needed to present to these men in order to get work” in Libya.

Among Unaoil’s corrupt insiders was the powerful Libyan official, Mustafa Zarti, a confidant for the Gaddafi regime. Unaoil’s files describe Zarti as “good friends of President Ghadafi’s [sic] son of Libya and have lot of influence in lobbying the jobs in Libya”. Unaoil agreed to secretly pay Zarti millions of dollars. In return he would use his influence to advantage Unaoil’s clients.

“MZ [Zarti] sits on the board of LFIC [Libyan Foreign Investment Committee] … which controls… Oil fund ($6bn) … He sees his role as us executing and him fixing issues we come across. MZ has agreed to bring all his oil & gas work to us,” a September 2006 Unaoil memo said.

Unaoil’s multinational clients in Libya included Malaysian giant Ranhill, Korean conglomerate ISU and Spanish company Tecnicas Reunidas.

SYRIA AND YEMEN

In Syria, Unaoil turned to a middleman close to the regime of Syrian president Bashar al-Assad.

In 2008 and 2009, Unaoil promised the man 2.75 million euros who helped its British client Petrofac win contracts from Assad regime petroleum companies. “Strictly confidential” emails from 2008 show this middleman promised to pay others to win these contracts.

But when he was not paid on time, he complained the delays were causing problems with “friends” in Syria.

“It is becoming very unpleasant [sic] for me not delivering as expected,” he wrote to Unaoil in December 2009.

Petrofac is understood to be unaware of Unaoil’s involvement in its Syrian dealings and in response to questions said it “aspires to the highest standards of ethical behaviour”.

In Yemen, Unaoil paid millions to a. Swiss account belonging to fixer and businessman Haitham Alaini, the son of the former Yemeni prime minister. In return, Alaini used his contacts in the Yemen to help Unaoil.

KUWAIT AND THE UAE

In Kuwait, Unaoil had on its payroll a powerful official who they called “the big cheese.”

To direct a contract to Unaoil’s long term client in the Middle East, US firm FMC Technologies, Unaoil wanted a payment of $2.5 million. It then planned to assign a middleman to handle “the big cheese in Kuwait and to decide what portion… should go to that man”.

In the UAE, Unaoil’s network included a public official with links to the Crown Prince of Abu Dhabi. The leaked Unaoil files reveal this official had commercial dealings with the Ahsanis who, in return, were seeking the official’s backing in the region. This included an entree to a project funded by the office of “His Highness Sheikh Mohammed Bin Zayed”.

Unaoil corrupted a senior official in a subsidiary of Abu Dhabi’s National Oil company. This insider rigged a tender panel for a Unaoil client, Indian conglomerate Larsen & Toubro.

20 Attorneys General Launch Climate Fraud Investigation of Exxon

In a move many are hailing as a “turning point” in the climate fight, 20 state Attorneys General on Tuesday launched an unprecedented, multi-state effort to investigate and prosecute the “high-funded and morally vacant forces” that have stymied attempts to combat global warming—starting with holding ExxonMobil and other industry giants accountable for fraud and suppression of key climate science.

“This is about facts, and science, and transparency,” said Massachusetts Attorney General Maura Healey, who spoke at a press conference alongside New York Attorney General Eric Schneiderman, former Vice President Al Gore and seven other Attorneys General.

“Fossil fuel companies that deceived investors and consumers about the dangers of climate change should be, must be held accountable,” Healey continued, saying there is a “troubling disconnect between what Exxon knew, what industry folks knew and the company and industry chose to share with investors and the American public.”

The coalition of Attorneys General from 16 states and the U.S. Virgin Islands was convened by Schneiderman, who in November announced a state investigation into Exxon after reporting revealed that the oil giant had for decades known and suppressed evidence about the dangers that fossil fuels posed to the environment and then purposely disseminated false information in order to boost its profits.

California has also launched an investigation and on Tuesday Healey and U.S. Virgin Islands Attorney General Claude Earl Walker confirmed their states have as well. Schneiderman said that additional states were pursuing similar action and that the purpose of the coalition is to work together in this “common interest.”

“The scope of the problem we are facing, the size of the corporate entities and alliances and trade associations [working against science and public interest] is massive and it requires a multi-state effort,” Schneiderman said.

AG Walker said that Puerto Rico and the Virgin Islands are already “experiencing the effects of global warming,” from coral bleaching and the proliferation of seaweed, to ever-more powerful hurricanes.

“It is troubling that, as the polar caps melt, there are companies that are looking at that as an opportunity to go and drill, to go and get more oil. How selfish can you be?” Walker asked. “Your product is destroying this Earth and you want to do what? Destroy the planet further,” he added, saying they have “documents” showing just that.

“We will not stop until we get to bottom of this and make it clear we have to do something transformational,” he added. “We cannot continue to rely on fossil fuels.”

Environmental groups that have spearheaded the call for accountability and investigations into what Exxon knew heralded the announcements and the new AG climate coalition.

“This creates a huge sense of momentum. Exxon may have been able to brush aside a few isolated inquiries, but with more states jumping on board, these investigations are sure to generate some serious waves,” said May Boeve, executive director of 350.org, which on Tuesday launched the website ExxonKnew.org to share information about the investigations and petition the U.S. Department of Justice and state Attorneys General to “hold Exxon accountable.”

“The Exxon revelations may turn out to be the largest corporate scandal in history,” Boeve continued. “Everyone is impacted by climate change, which means everyone has a stake in these investigations. A trial of ExxonMobil and the fossil fuel industry would be even bigger than the cases against Big Tobacco.”

As Katherine Sawyer, senior international organizer for watchdog group Corporate Accountability International, explained in an emailed statement following the press conference:

“In the ’90s, investigations by attorneys general were the beginning of the end for Big Tobacco as we knew it and ushered in a series of lawsuits that shuttered its front groups, forced the release of internal documents and held it liable to pay the high cost of its impacts on society. Just as a similar coalition did with Big Tobacco, this powerful coalition of state Attorneys General are leading the way in holding Exxon and the rest of the fossil fuel industry accountable for their decades of deception and protecting climate policy from their profit-driven interference.”

“Big Polluters have done everything in their power to deny climate change, it is time for our justice system to take back the climate debate,” declared Annie Leonard, Greenpeace USA executive director, who said the AGs’ announcement was “a clear demonstration of climate leadership.”

The coalition includes Attorneys General from California, Connecticut, District Of Columbia, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, New Mexico, New York, Oregon, Rhode Island, Virginia, Vermont, Washington state and the U.S. Virgin Islands.

Appearing alongside members of that group, former Vice President Al Gore, whose 2006 documentary film An Inconvenient Truth is credited with spurring public debate about climate change, said, “I really believe that years from now this convening … may well be looked back upon as a major turning point in the effort to hold to account those commercial interests … who have been deceiving the American people about the dangers of climate change.”

Six youth plaintiffs on Monday appealed Denver District Court Judge Eric Elliff’s adverse decision to their fracking and climate change lawsuit. In his decision, Judge Elliff affirmed the Colorado Oil and Gas Conservation Commission’s order to deny the fracking petition brought by the young plaintiffs, determining that the commission is required to “strike a balance between the regulation of oil and gas operations and protecting public health, the environment and wildlife resources.”

Contrary to the plain language of the Colorado Oil and Gas Conservation Act, the court said that is appropriate for the Colorado Oil and Gas Conservation Commission to “balance” oil and gas development with the need to protect public health, the environment and wildlife. In reaching this conclusion, the court ignored plaintiffs’ arguments that such an interpretation of Colorado’s Oil and Gas Conservation Act would allow for the continued infringement of their constitutional rights, including “the right of enjoying and defending their lives and liberties; of acquiring, possessing and protecting property; and of seeking and obtaining their safety and happiness,” rights that oil and gas development are harming. The court also ignored the plethora of evidence before it detailing the serious harms that oil and gas development is causing to Coloradans public’s health and to the environment.

“Our health and safety are on the line,” said Xiuhtezcatl Roske-Martinez, 15-year-old plaintiff and youth director of Earth Guardians.

“For the future of all Coloradans, it was imperative for us to file this appeal. It’s a preposterous idea that the commission need to strike a balance between regulation of oil and gas operations and protecting the health of Coloradans. The commission’s priority should be the health and safety of us, the people. Right now, our government is putting their profits above our futures and that needs to stop.”

The case was brought by six inspiring youth who are all members of the Boulder-based organization Earth Guardians. The youths’ case against the commission arose out of a petition for rulemaking that asked the commission to stop issuing permits that allow oil and gas drilling until it is proven that drilling can be conducted without adversely impacting human health and safety and without harming the environment and wildlife. The commission denied the petition, finding that it did not have the authority to issue the requested rule and that “other commission priorities … must take precedence.” The plaintiffs challenged this decision, arguing that the commission must place human health and safety above the interests of the oil and gas industry in Colorado.

“Without question, this decision places public health at a level that is only as important as corporate dollars,” said Julia Olson, a native Coloradan and executive director and chief legal counsel at Our Children’s Trust.

“The health, safety and welfare of all Coloradans are now subordinate to the interests of fossil fuel industry’s development of oil and gas resources. While no one suggests that public health, safety and welfare should be the sole factors, they should certainly be the primary factors in everything the state does, including natural resource development. This court went so far as to say that there is no legislative intent to make public health the primary factor in defendants’ decisions to issue oil and gas permits.”

The six youth plaintiffs and their attorneys are hopeful that the district court’s decision will be reversed by the Colorado Court of Appeals.

90,000 gallons of oil spilled in the Gulf of Mexico and no one is talking about it

Yet Another Oil Spill Wreaks Havoc On The Gulf Of Mexico And Nearby Coastal Communities

A Shell oil facility has leaked nearly 90,000 gallons of oil into the Gulf of Mexico, according to federal authorities. The spill has left a two-mile by thirteen-mile sheen in the Gulf, approximately 165 miles southwest of New Orleans. A helicopter first noticed the spill near Shell’s Brutus platform on Thursday morning, according to Shell spokeswoman Kimberly Windon.

“There are no drilling activities at Brutus, and this is not a well control incident,” Windon told the Associated Press. Instead, authorities believe the leak came from a release of oil from subsea infrastructure, from a line connecting four wells. According to the Wall Street Journal, Shell had dispatched boats Friday to begin cleaning up the spill.

“We are working with the United States Coast Guard and the National Oceanic Atmospheric Association to define the best approach to contain and clean up the sheen,” Windon said.

According to the United States Coast Guard, the leak has been secured, and the Bureau of Safety and Environmental Enforcement is reporting no injuries from the spill.

Local activists, however, are unconvinced by reports that the spill is over. The spill occurred a little less than 100 miles due south of Lousiana’s Terrebonne Parish, which is home to one of the country’s largest communities of Houma Native Americans, who still depend on subsistence lifestyles. If the spill impacts marine life, or washes ashore, it’s likely that these communities might be some of the first impacted.

“You sit down for dinner and you watch the news and you see another spill with tens of thousands of gallons of oil and reports that no one is hurt or the leak has stopped and you know, just from experience, that that’s probably not true,” Colette Pichon Battle, executive director of the Gulf Coast Center for Law and Policy, told ThinkProgress “Who is really going to be hit? It’s going to be our Native American communities that live on, and depend on, the coast. It’s going to be the poorest people on the coast that depend on the ecosystem to be healthy.”

 

The spill comes just days before Battle and others are set to travel to Washington, D.C. for a rally to stop offshore drilling scheduled for Sunday. Organizers expect the event — which will include a march from the White House to the Lincoln Memorial Reflecting Pool — to draw more than a thousand participants from communities along the Arctic, Atlantic, and Gulf coasts.

Participants hope that the rally will encourage the Obama administration to reconsider allowing offshore drilling in the Gulf and the Arctic under the administration’s new five-year leasing plan. The plan has taken Atlantic drilling off of the table, largely in response to community opposition, but would still allow oil permits in the Arctic and the Gulf.

Battle noted that the spill occurring just days before the rally simply underscores the dangers that offshore drilling can pose to local communities.

“You see this [spill] happening right now, and then you read the federal government’s five-year plan to do more drilling, more exploration, and lease off more land,” she said. “If you live in south Louisiana, you know that’s going to mean more spills.”

In 2010, a BP oil rig exploded in the Gulf, killing 11 men and releasing some 4.2 million barrels of oil into the water in what would become the largest offshore oil spill in history. BP was eventually ordered to pay a $20.8 billion settlement, along with another $4 billion settlement resulting from a federal criminal probe. Thanks to the U.S. tax code, however, BP can classify up to $15 billion of that as a “business expense,” potentially saving the company as much as $5 billion.

The Stó:lō collective of First Nations in British Columbia is very familiar with the transport of oil. The existing Trans Mountain pipeline has crossed through their land for more than 50 years. CN Rail also carries oil by rail directly across Stó:lō territory to the B.C. coast.

So, the collective of eleven First Nations in B.C.’s Fraser Valley came to consultations with Kinder Morgan for the expansion of Trans Mountain with an open mind.

“We have taken time to speak to Kinder Morgan,” said Ernie Crey, the chief of the Cheam First Nation, a member of the collective.

“We’ve also weighed and considered a new pipe versus seeing all this bitumen moving along the rail lines straight through many of our communities. Some of the houses in our communities are literally feet from the rail line.”

But Crey said the nations were also concerned about the pipeline’s proximity to the Coquihalla River, which feeds into the Fraser River.

“I think their responsibility and duty goes much deeper to us than to send a few public officials to [a] meeting with us for an hour or two.” – Ernie Crey, Stó:lō Collective

“The Fraser River is the most productive salmon-bearing stream on Earth and we depend on the annual runs of salmon.”

A breach of either the oil or new Trans Mountain pipeline in the summer months would be disastrous for the salmon run.

Pipe versus rail

“We weighed and considered a pipe versus all this product being moved by rail and we considered what was the wiser of two difficult choices, bitumen by rail and bitumen by pipe and we thought the safer bet might be bitumen by pipe,” said Crey.

But the Stó:lō did not sign onto the project, a sign that the consultations done by Kinder Morgan, considered acceptable by the National Energy Board, did not go far enough to convince even those who had an open mind about the pipeline expansion.The Stó:lō are not formally opposed to the project either, as one of the nations most affected by the expansion, they simply remain to be convinced.

That does not leave an easy job for three-member panel appointed this week by the federal government to further consult with communities along the route.

Crey said that representatives from Natural Resources Canada have visited the Stó:lō in recent weeks.

“They’ve made a one-time pass through our community. I’ve referred to it as a drive-by consultation,” said Crey. “I think their responsibility and duty goes much deeper to us than to send a few public officials to [a] meeting with us for an hour or two.”

Farther down the pipeline route, the Tsleil Waututh First Nation has little faith that the panel will be able to bring opponents onside.

The territory of the Tsleil-Waututh includes the Burrard Inlet, which would see increased tanker traffic if Trans Mountain is approved. The First Nation is steadfastly opposed to the project and plans to challenge it in the courts.

“They did that NEB process in 25 months,” said Rueben George, a spokesman for the Tsleil Waututh. “And you’re going to try to take care of that big mess in four months, that’s ridiculous.”

Consult or consent?

George said that the legal landscape has changed for First Nations and resources development.

“First Nations are winning 97 per cent of our court cases around resource extraction. That’s 170 legal cases in the last couple years. That’s a lot of veto power right there.”

The most significant case fought by First Nations was decided in June, 2014, by the Supreme Court of Canada, which ruled that provincial and federal governments must win consent of Aboriginal groups when regulating economic activity on titled lands, unless it can show a pressing public need for that activity.

That case was brought forward by the Tsilhqot’in nation in response to clear-cutting of trees on its territory. Since the decision, there has been a shift in which First Nations now feel that the duty to consult means corporations and government really need to seek consent.

“We’ve been doing the traditional ‘duty to consult’ types of processes for 10 or 15 years,” said Bruce McIvor, a lawyer with First Peoples Law.

Courts will ultimately decide

“But since the Tsilhqot’in decision in 2014 and the full adoption of UNDRIP [The United Nations Declaration on the Rights of Indigenous Peoples] by the federal government, we’re moving out of that need-to-consult type of process and we’re moving toward consent-based consultation. That’s where we’re going.”

McIvor said the National Energy Board decision yesterday, or the final decision by cabinet in December, will not be the last word on Trans Mountain.

“The process that the NEB went through will be reviewed by the courts and if the courts find that it doesn’t live up to the government’s obligations under Section 35 of the constitution, it has a wide latitude to null the decision to tell them to go back and do it again.”

Crimson Pipeline LLC. had a 10-inch pipe buried underground which burst this week along the California coastline. An estimated 29,000 gallons of crude oil spilt. In the last decade, Crimson Pipeline, LLC. has had 10-spills. In this instance, the oil missed leaking into the ocean, but will have devastating consequences on the surrounding environment in Ventura County. The responsible company has been fined several times by the EPA which has done little to stop events like these from occurring and continues to allow the company to remain in operation.

JULY 13, 2016: While flying over New Mexico on July 12, 2016 I noticed an unusual large plume to the north, a large fire of some sorts and started taking video because sand typically does not burn and I found it simply put, out of place for a wildfire. It was not a wildfire, a frack well explosion had occurred.

This Wednesday, I had barely had breakfast when I was surprised by some absolutely amazing news: the Brazilian environmental agency — IBAMA announced it would cancel the process for licensing the São Luiz do Tapajós (SLT) megadam in the heart of the Amazon. Once my heart rate returned to normal, I started to call my colleagues and Munduruku leaders, seeking confirmation.

Today, it’s official: The Brazilian environmental agency has cancelled the São Luiz do Tapajós megadam. It’s time to celebrate this incredible news!

I would like to thank all of you — more than 1.2 million people around the world — who stood with the Munduruku Indigenous People to say no to the SLT dam and pressure multinational companies like Siemens to distance themselves from the project.

You made this victory possible!

Over these last months we truly believed that sooner or later IBAMA would need to recognize the megadam project’s significant environmental and social impacts in the region. Now, with IBAMA’s decision, the approval process for the megadam cannot move forward.

Other Brazilian agencies like FUNAI (National Indigenous Foundation) and federal public prosecutors in the Brazilian state of Pará had recommended that IBAMA cancel the license because the project would displace Munduruku communities, making it unconstitutional. Part of the Munduruku Indigenous land called Sawré Muybu – an area in the process of been officially recognized as Indigenous Land – would have been flooded by the dam.

Now that the megadam’s license has been cancelled, the Brazilian Ministry of Justice must recognize its obligation and move swiftly to officially demarcate the Sawré Muybu territory.

Although, we are celebrating this incredible victory, we know there is a lot more to do to keep the Tapajós and other Amazon rivers free from hydrodams. Our campaign has not finished yet!

There are 42 other hydrodam projects planned in the Tapajós basin and hundreds earmarked across the Amazon rainforest – part of an aggressive economic model that doesn’t consider the critical importance of protecting the Amazon forest and its inhabitants. Previous dams build in the Amazon have negatively impacted local communities, devastated the environment and even been mired in corruption scandals.

We need to stop them, one by one!

The Brazilian government plans to build a series of dams in the Tapajós River basin, which would severely threaten the fauna, flora and life of the Indigenous people living along the river. There is another way.

Brazil must focus on truly renewable energy and become a world leader in wind and solar.

With the right investments, it is possible to generate the same amount of energy that dams like São Luiz do Tapájós would produce, by harnessing the power of wind and sun.

A recent report discloses that the oil industry is benefiting from 5.3 trillion in subsidies annually. The oceans are absorbing so much Co2 that the acidification of the seas is unparalleled over at least the last 300 million years. Massive marine ecosystem collapse is occurring all over the globe. If the oceans die, we die. NBC has just published the following headline, “Climate Engineering: Scary idea should be tried out” (as if the weather warfare assault has not already been going on for over 70 years.  Where is Mr. Trump? He has just made his 9th trip to one of his golf courses since taking office.
Many are beginning to awaken to the peril that is surrounding us from all sides. This being said, the pace of the wake-up must increase if we are to have any chance altering our trajectory before total societal collapse commences. The threats we face are existential, all are needed in the critical effort to sound the alarm. We will sink or swim together.
